Introduction
These Amadeus CheckMyTrip Terms and Conditions (“Terms and Conditions”) describe the conditions subject to which a user (“User” or “You”) may use and access, CheckMyTrip mobile application (“CMT Application”) and relevant services (together “CheckMyTrip” or “CMT”) provided by Amadeus IT Group SA, a company with headquarters at Calle Salvador de Madariaga 1, 28027 Madrid, Spain (“Amadeus”, “we” or “us”) and aimed at bringing you all travel information and digital assistance services you need in one place.
By accessing and using CheckMyTrip, you agree to be bound by these Terms and Conditions and any other terms incorporated herein by reference such as CheckMyTrip Privacy Statement. If you don’t agree to these Terms and Conditions, you may not access and use CheckMyTrip. We recommend that you read these Terms and Conditions carefully in order to understand Your and Amadeus’ rights and obligations applicable to CheckMyTrip.
When accessing or buying services provided by third parties in connection with CheckMyTrip, you will be subject to those third parties’ terms and conditions.
Access and Use of CheckMyTrip
A. Age restriction
CheckMyTrip is available only to natural persons over the age of legal majority in their country and who can enter into legally binding agreement(s) under applicable law. If you are not the age of legal majority, you should not use CheckMyTrip.
B. Service Overview
CMT Application is a digital travel assistant designed to provide flight information, alerts and travel services to get you smoothly from door to door (“CMT Services”). CMT Services enable you to i) manage your trips, ii) receive instant trip notifications (i.e. delays, cancellations and terminal changes) and relevant trip information (i.e. travel requirements, weather forecast) iii) book extra travel services offered by third-party providers (i.e. transfers, parking, lounge access) wherever you are in the world.
All information made available to you through the usage of CheckMyTrip shall be referred as CMT Content.
C. CMT Account
To access and use CMT, you shall register and create an account (“CMT Account”) on CMT Application. When creating your CMT Account, you shall provide accurate and complete information about yourself and update your information as necessary to keep it accurate and complete. The personal information collected during the registration process will be subject to CMT Privacy Statement.
D. Use of CheckMyTrip Services
After your registration, you will be requested through the chatbot of the CMT Application to add your upcoming trips in order to use CMT Services. You can add trips: i) by providing your booking reference number to import a trip which has been booked with a customer of Amadeus Global Distribution System; ii) by forwarding you booking confirmation e-mail(s) to trips@checkmytrip.com; or iii) by manually entering your flight number and/or trip information
After you import your Trip, we will send you, through the chatbot available in the CMT Application, relevant and contextualized information and suggestions of services in connection with your trip an. Please note that the information and suggestion of services we push to you may come from our third-party providers – therefore we recommend you double checking any information received through CheckMyTrip with your relevant airline or airport. You have the option to deactivate the push notification in your profile parameters.
E. Intellectual Property Rights and Restrictions on Use
Any Intellectual Property Rights associated with CheckMyTrip remain the sole property of Amadeus, its Affiliates or licensors (as the case may be) and nothing in these Terms and Conditions intends to transfer any Intellectual Property Rights to, or to vest any Intellectual Property Rights in you. Any reproduction, copying, publication, distribution, modification, transformation, removal, handling, and any other use, with or without profit, all or part of CheckMyTrip or any of its contents, without the prior express written permission of Amadeus is expressly prohibited.
You may not use CheckMyTrip to: a) copy, transmit, re-distribute, reproduce, replicate, repost or create derivative based on CMT Content and/or CMT Services or any portion thereof, including incorporate any part of CMT Content and/or CMT Services into any other website or service; b) try to modify, reverse engineer, reverse assemble or otherwise alter CMT Website and/or CMT Application (except to the extent this is authorized by applicable law); c) do anything that is prohibited under applicable law; d) upload or transmit viruses or any other type of malicious code, spam, spyware or malware that may compromise the functionality of CMT Services; e) share content that is misleading, inappropriate, unlawful, harmful, threatening, abusing, defamatory, pornographic, libelous, invasive or hateful; f) for any commercial purposes.
In case of inappropriate use of CMT as described above, we reserve the right to engage any legal action against you and/or to terminate your access of CMT Services.
F. Deletion of CMT Account
If you have created a CMT Account and wish to stop accessing CMT Services and terminate these Terms and Conditions, you can do so at any time by deleting your account on CMT Application and no longer accessing the Services. If you do so, all your Personal Data will be deleted accordingly, and these Terms and Conditions will cease to apply.
G. Exclusion of the right to withdrawal
Due to the nature of CheckMyTrip Services, you are aware and accept that you are not entitled to withdraw from the services provided through CheckMyTrip. Indeed, the provision of the abovementioned services is fully performed when You use CheckMyTrip, excluding the right to withdrawal, in accordance with applicable law.
Availability of CheckMyTrip
CheckMyTrip is designed to be available 24h/24, except for any maintenance purposes, Force Majeure Event or any other event out of Amadeus control. However, Amadeus does not guarantee the availability of CMT Application and CMT Services and reserves the right to modify or discontinue CheckMyTrip, on a temporary or permanent basis, at any time with no liability towards you or any third party.
User Feedback
You are solely responsible for the travel information, content, conversations, feedback or other materials you transmit through CheckMyTrip (“User Feedback”).
You grant to Amadeus a perpetual, nonexclusive, worldwide, royalty free, fully paid up, transferable license to use the User Feedback as necessary for Amadeus to provide CheckMyTrip Services to you and for any internal purposes, including to improve CheckMyTrip.
Data Protection
All the Personal Data collected during registration process or through your use of CheckMyTrip will be subject to CheckMyTrip Privacy Statement.
Third-Parties Website and Content
CMT Services contain links to third-party providers websites or interfaces to enable you to book services with third-party providers. Such websites are controlled by independent parties under which Amadeus has no control. Amadeus is technology provider specialized in the travel industry but does not provide its own travel and transportation services, activities or experiences. Although CMT Services provide information about third-party suppliers and facilitate bookings with these third-party providers, such Service(s) not constitute any sponsorship, affiliation or endorsement of these third-party providers.
We remind you that by accessing third-party websites or by booking third-party services made available or suggested through CMT Service(s), you agree to be bound by these third-parties’ policies and terms and conditions. We encourage you to review these terms and conditions and policies and to use them at your own risk. You will need to make your own independent judgement regarding your interaction with any operators of Third-party Sites, including the purchase and use of any products or services accessible through them.
YOU HEREBY ACKNOWLEDGE AND AGREE THAT AMADEUS WILL NOT BE A PARTY TO ANY AGREEMENT ENTERED WITH ANY SUCH THIRD-PARTY AND WILL NOT BE RESPONSIBLE FOR ANY ERRORS OR OMISSIONS IN SUCH THIRD-PARTIES’ WEBSITES OR FOR ANY DIRECT OR INDIRECT CLAIM, BREACH, LOSS OR DAMAGE CAUSED OR ALLEGEDLY CAUSED BY OR IN CONNECTION WITH THE ACCESS OR USE OF SUCH THIRD-PARTIES’ WEBSITES. However, , in case Amadeus is aware of the unlawfulness of such content or links, it undertakes to eliminate or disable the links, as well as, where appropriate, blocking those contents that may be unlawful or infringe the rights of any third party, in accordance with applicable law.
Disclaimer of Warranties and Limitation of Liability
AMADEUS HAS MANY SOURCES OF INFORMATION AND DATA THAT MAKE UP THE CMT CONTENT MADE AVAILABLE THROUGH CHECKMYTRIP. ALTHOUGH AMADEUS TRIES TO PROVIDE ACCURATE INFORMATION, CHECKMYTRIP MAY BE SUBJECT TO OMISSIONS AND ERRORS. CMT WEBSITE, CMT APPLICATION, CMT SERVICES AND CMT CONTENT ARE PROVIDED ‘AS IS’. TO THE FULLEST EXTENT PERMITTED BY LAW, AMADEUS DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD-PARTY’S RIGHTS AND FITNESS FOR A PARTICULAR PURPOSE. AMADEUS MAKES NO REPRESENTATIONS OR WARRANTIES THAT CMT WEBSITE, CMT APPLICATION AND CMT SERVICE(S), INCLUDING CMT CONTENT MADE AVAILABLE THROUGH CMT SERVICE(S) WILL MEET YOUR REQUIREMENTS AND BE SECURE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, TIMELY, UNINTERRUPTED, ACCURATE, COMPLETE OR RELIABLE.
YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF CHECKMYTRIP IS AT YOUR OWN RISK AND THAT CHECKMYTRIP IS MADE AVAILABLE TO YOU AT NO CHARGE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AMADEUS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL LOSSES OR DAMAGES OR ANY LOSS OF INCOME, PROFITS, GOODWILL ARISING OUT OF OR IN ANY WAY RELATED TO i) THE ACCESS AND USE OF CHECKMYTRIP, II) DELAY OR INABILITY TO ACCESS CHECKMYTRIP; III) VIRUS, BUGS, TROJAN HORSES, SOFTWARE, INFORMATION, THIRD-PARTIES’ LINKED WEBSITES, SERVICES OBTAINED THROUGH THE USE OF CHECKMYTRIP OR ANY OTHER MATTER RELATING TO THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF AMADEUS, IT AFFILIATES OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THESE TERMS AND CONDITIONS DO NOT AFFECT ANY OF YOUR STATUTORY LEGAL RIGHTS THAT CANNOT BE EXCLUDED BY LAW. IF YOU ARE NOT SATISFIED WITH ANY PORTION OF THE CMT SERVICES OR WITH THESE TERMS AND CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF CHECKMYTRIP.
General provisions
A. Entire Agreement
These Terms and Conditions are the complete and exclusive statement relating to its subject matter and supersede all prior communications (oral or in writing) between you and Amadeus.
B. Assignment
You may not transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may transfer any of our rights or obligations under these Terms and Conditions to any of our affiliates or any third party designated by Amadeus.
C. Changes
Any new functionalities of CheckMyTrip will be subject to these Terms and Conditions. We reserve the right to amend sections of these Terms and Conditions at any time. We will notify you of the change with details of the change or notifying you of a change when you next access CMT Website or Application. You may be required to read and accept the new terms to continue your use of the CMT Services. If you do not wish to accept the new terms, you can stop using the CMT Services and delete your account.
D. Severability
If any provision (or part thereof) of these Terms and Conditions is held by any court, or other competent authority to be void or unenforceable in whole or part, such void provision shall be deemed to be replaced by an enforceable provision with the closest effect possible to the original provision and these Terms and Conditions shall continue to be valid with respect to the other provisions and the remainder of the affected provisions
E. Waiver
Any failure or delay by us in enforcing (in whole or in part) any provision of these Terms and Conditions will not be interpreted as a waiver of our rights or remedies.
F. Governing Law and Jurisdiction
This Agreement and any dispute or claim arising out of or on connection with them (including non-contractual disputes or claims) is governed by the laws of England and Wales, without regard to conflict of laws principle. You agree, for the sole benefit of us, that the courts of London, England, shall have exclusive jurisdiction over any dispute or claim (including non-contractual disputes or claims) You may have against us and/or our Affiliates arising out or in connection with this License Agreement. Nothing in this section shall limit our right to take proceedings against You in any number of other courts of competent jurisdiction (including arbitration courts), whether concurrently or not, to the extent permitted by the law of such other jurisdiction.
G. Online Dispute Resolution
In accordance with Regulation (EU) 524/2013, the European Commission provides consumers a free platform for alternative online disputes resolution to which the parties can submit voluntarily. You can find additional information at the following link: https://ec.europa.eu/consumers/odr/.
